Ippayware Terms
These Payment Gateway Terms (“Terms”) set forth the terms and conditions under which Ippayware (“Ippayware LLC”) provides payment processing services to merchants (“Merchant”) who use the Payment Gateway to process payments from customers (“Customers”). By using the Payment Gateway, the Merchant agrees to be bound by these Terms.
Payment Processing
The Payment Gateway shall provide payment processing services to the Merchant, allowing the Merchant to accept payments from Customers via credit card, debit card, and other payment methods. The Payment Gateway shall transmit payment data securely to the Merchant’s bank account.
The Payment Gateway shall use the latest technology to ensure the security and protection of all transactions made through its platform. The Payment Gateway shall also monitor transactions to identify and prevent fraudulent activities, and shall inform the Merchant of any suspicious transactions.
Fees
The Payment Gateway shall charge fees to the Merchant for payment processing services. The fees shall be based on the volume of transactions processed by the Merchant. The fees shall be set forth in the Merchant’s agreement with the Payment Gateway.
The Payment Gateway shall provide the Merchant with a detailed breakdown of all fees charged, including any additional charges or fees for chargebacks, refunds, or disputes.
Merchant Obligations
The Merchant shall comply with all applicable laws, rules, and regulations related to the acceptance of payments from Customers. The Merchant shall ensure that all information provided to the Payment Gateway is accurate and up-to-date. The Merchant shall be responsible for any chargebacks, refunds, or disputes related to payments processed through the Payment Gateway.
The Merchant shall also ensure that its website or application complies with all Payment Card Industry Data Security Standards (PCI DSS). The Payment Gateway shall provide the Merchant with guidelines and recommendations to help the Merchant comply with PCI DSS.
Payment Gateway Obligations
The Payment Gateway shall provide payment processing services to the Merchant in accordance with these Terms. The Payment Gateway shall transmit payment data securely to the Merchant’s bank account. The Payment Gateway shall provide support to the Merchant for any issues related to payment processing.
The Payment Gateway shall also provide the Merchant with access to its reporting tools, which shall allow the Merchant to access detailed information about its transactions, fees, chargebacks, refunds, and disputes.
Termination
Either party may terminate these Terms at any time upon written notice to the other party. The Merchant shall remain responsible for any fees or charges incurred prior to termination.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of US without giving effect to any principles of conflicts of law.
Entire Agreement
These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous communications and proposals, whether oral or written, between the parties.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
